By providing Spirit Pieces with your personal or personally identifiable data and using the Website, you warrant that you are over the age of eighteen (18) or otherwise above the age of majority within your jurisdiction. If you are younger than eighteen (18) or the age of majority within your jurisdiction, please do not use the Spirit Pieces Website and please do not provide personal information to us.
What information do we collect and how do we use it?
When you use the Website, we may collect personal or personally identifiable information from you (“PII”). PII may include any information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual. It does not include anonymized data.
We may collect and process the following categories of PII about you:
• Communication Data. Communication data includes any communication that you may send to us through the website, email, chatbot, or social media. • Biometric Data. When using the Website’s fingerprint personalization tool, we may collect biometric data from you, including photos or line drawings of your fingerprints or the fingerprints of your loved ones. By submitting fingerprint data to Spirit Pieces, you represent and warrant that you have all necessary permissions, rights, and authority to submit fingerprint data to Spirit Pieces and to provide express and informed written consent for the use of this biometric data. This biometric data is solely used to provide Spirit Pieces’ fingerprint personalization functionality and for no other purposes and all such biometric data will be deleted after use or within three (3) years of Spirit Pieces’ collection of such data. When submitting biometric data to Spirit Pieces, you understand and agree that your biometric data may be stored on cloud servers owned by third-party service providers that have contracted with Spirit Pieces to provide file storage services.
• User Data. User data includes data about how you use the Website and any data that you post to or authorize through the Website, such as your name, address, country, phone number, and email address. This includes data stored in persistent cookies when you login to the Website and analytics data that is collected when you use the Website. We collect and process this data to operate the Website, to authenticate you as a user of the Website, to ensure that timely and relevant content is provided to you, to secure the Website, to ensure that the Website operates in a fast and efficient manner, and to maintain backups of the Website. Spirit Pieces’ lawful ground for processing this user data is its legitimate business interests in administering and offering the Website and to fulfill your orders for products through the Website.
• Technical Data. Technical data includes data about your use of the Website, such as your IP address, your login data, your phone number, your mobile device model, your operating system, your geolocation, and your time zone. We may collect this data from your use of the Website and from advertising IDs. Spirit Pieces processes this data to analyze your use of the Website, to route Website traffic, to administer and secure the Website, to provide location-relevant content, and to troubleshoot problems with the Website. Spirit Pieces’ lawful ground for collecting and processing this technical data is its legitimate interests in administering and offering the Website and to grow its business and marketing strategy.
• Marketing Data. Marketing data includes data about your preferences in receiving and interacting with Spirit Pieces’ advertisements or content on the Website. We collect this data from your use of the Website and from advertising IDs created through advertising programs, such as Google Advertising IDs and advertising IDs associated with other platforms. Spirit Pieces does not connect advertising identifiers to persistent device identifiers, such as MAC addresses or mobile device IDs. Spirit Pieces’ lawful ground for collecting and processing this marketing data is its legitimate interests in administering and offering the Website and to grow its business and marketing strategy by providing advertisements, including remarketing advertisements, to you.
• Personally Sensitive Data. Personally sensitive data includes data about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, union membership, or information about your health. Spirit Pieces does not collect personally sensitive data, but it may collect biometric data in the manner described above.
Spirit Pieces will only use your PII for the purpose for which it was collected. If Spirit Pieces needs to use your PII for an unrelated new purpose, Spirit Pieces will provide you with notice of this new use and will explain the lawful ground for such processing. Spirit Pieces may process your PII without your knowledge or consent where required or permitted by law.
Spirit Pieces does not use your PII to automatically make any decisions or to create an automated profile about you.
What information do we collect from third parties and how do we use it?
Spirit Pieces may collect data about you through cookies and other technologies. This helps Spirit Pieces understand how you use the Website and to understand any patterns that may be associated with your use of the Website. This aids Spirit Pieces in developing or improving its Website and marketing communications in response to your needs or wants.
Spirit Pieces may use session or persistent cookies. Session cookies are only stored on your computer or mobile device during your use of the Website and are automatically deleted when you close your web browser. Session cookies may be used to direct internet traffic to a server that is closer to you or to allow us to identify you as you move between pages of the Website. Tracking Technologies and Pixel Disclosure
Spirit Pieces uses various tracking technologies, including tracking pixels, tags, and scripts, on its Website. Tracking pixels are small pieces of code (often invisible image files or JavaScript snippets) that, when loaded by your browser, transmit information about your device, browser, and behavior on the Website to Spirit Pieces and/or to the third parties described below. These technologies may collect or transmit data in real time as you interact with the Website, including page views, clicks, form interactions, and other behavioral data.
You are hereby notified that the following specific tracking technologies are currently deployed or have been deployed on the Website, and that these technologies may collect, record, or transmit information about your interactions with the Website to third parties. Klaviyo
Klaviyo is an email marketing and customer data platform. Spirit Pieces uses Klaviyo to send marketing emails and to track user behavior on the Website, including page views, product views, and interactions, for the purpose of personalizing email communications and remarketing. Klaviyo may set cookies and tracking pixels on the Website and in Spirit Pieces’ emails. Klaviyo’s tracking pixel embedded in emails can record whether and when you open an email, your IP address, your email client, and your device information. Klaviyo’s on-site tracking may capture browsing behavior and associate it with your email address if you have previously interacted with Spirit Pieces’ emails or provided your email address on the Website. Data collected may include your email address, IP address, device and browser information, pages visited, products viewed, and purchase history. Google Analytics (Including Google Universal Analytics and Google Analytics 4)
Spirit Pieces has used Google Universal Analytics (UA/GA3) and currently uses Google Analytics 4 (GA4), both services provided by Google LLC. Google Universal Analytics was retired by Google on July 1, 2023, and historical UA data ceased to be accessible after July 1, 2024. Google Analytics 4 uses an event-based data model and may set first-party and/or third-party cookies to collect data about your interactions with the Website, including pages visited, time spent on the Website, clicks, and conversion events. Google Analytics may collect your IP address (which Google uses to approximate your geographic location, not to identify you individually), device and browser information, referral sources, and behavioral data. Spirit Pieces uses this data to understand how visitors use the Website and to improve the Website’s content and functionality. Google Conversion Tracking and Google AdWords Conversion
Spirit Pieces uses Google Conversion Tracking (also referred to as Google AdWords Conversion or Google Ads Conversion Tracking) to measure actions taken by users after clicking on a Spirit Pieces advertisement on Google’s advertising network. When a user clicks a Spirit Pieces advertisement, Google places a cookie on the user’s browser. If the user subsequently completes a conversion action on the Website (such as making a purchase), information about that conversion is sent to Google. This data allows Spirit Pieces to assess the performance of its advertising campaigns. Data collected may include cookie identifiers, referral information, the type of conversion action, and the value of a conversion. Global Site Tag (gtag.js)
The Global Site Tag (gtag.js) is Google’s unified tagging framework that Spirit Pieces uses to implement Google Analytics 4, Google Ads conversion tracking, and other Google measurement products from a single tag. Gtag.js loads the relevant Google tracking libraries and sends event data to Google. The data collected and transmitted through gtag.js depends on the Google products configured, as described in the individual product descriptions in this section. Google Conversion Linker
The Google Conversion Linker is a tag that reads Google click identifiers (GCLIDs) from the URLs of pages that users land on after clicking a Google ad, and stores those identifiers in first-party cookies. This allows Spirit Pieces to accurately attribute conversions to specific ad clicks even across multiple domains or in contexts where third-party cookies are restricted. Bing Universal Event Tracking (UET)
Spirit Pieces uses the Microsoft Advertising Universal Event Tracking (UET) tag, which allows Spirit Pieces to track actions taken by visitors to the Website after clicking on a Microsoft Advertising (Bing Ads) advertisement. The UET tag places a cookie on your browser and tracks your activity on the Website, including pages visited and conversion actions such as purchases. Data collected may include cookie identifiers, IP address, page URL, and conversion event data. Microsoft Clarity
Spirit Pieces uses Microsoft Clarity, a behavioral analytics service provided by Microsoft Corporation. Microsoft Clarity records and replays user sessions on the Website, including mouse movements, clicks, scrolling behavior, and keystrokes. Microsoft Clarity also generates heatmaps showing aggregate user interaction patterns.
IMPORTANT NOTICE REGARDING MICROSOFT CLARITY: Microsoft Clarity may record your interactions with the Website in real time, including the content you type into form fields on the Website. By using the Website, you are aware that your interactions may be recorded in this manner.
Spirit Pieces uses Microsoft Clarity to understand how users interact with the Website in order to improve the Website’s usability and design. Data collected may include IP address, device and browser information, mouse movements, clicks, keystrokes, and page content. Bing Conversion Tracking
Bing Conversion Tracking is a component of Microsoft Advertising (Bing Ads) that tracks conversions resulting from Bing ad clicks. It works in conjunction with the UET tag described above to attribute purchases and other conversion actions on the Website to specific Bing advertising campaigns. Data collected may include cookie identifiers, conversion event type, conversion value, and referral information. Yahoo Dot (Yahoo Pixel)
Spirit Pieces uses the Yahoo Dot tag (also known as the Yahoo pixel or Yahoo universal pixel), provided by Yahoo Inc. The Yahoo Dot tag allows Spirit Pieces to measure the effectiveness of its Yahoo advertising campaigns, track conversions, and enable audience targeting and retargeting on Yahoo’s advertising network. When you visit the Website, the Yahoo Dot tag may set cookies or collect device identifiers to record your visit and any conversion actions. Data collected may include cookie identifiers, IP address, device information, and conversion event data. How do we use your information for marketing communications?
As stated above, Spirit Pieces’ lawful ground for sending you marketing communications is either consent or its legitimate business interests, such as to grow its business by advertising products to you. Spirit Pieces may send you marketing communications if you have asked for information concerning its goods or services or if you have agreed to, and have not opted out from, receiving marketing communications. You may ask Spirit Pieces to stop sending you marketing messages at any time by logging into the Website to adjust your marketing preferences within your user account or by following the opt-out link in any marketing message sent to you. If you opt out of receiving marketing communications, your opt-out does not extend to PII provided for other purposes.
When do we disclose your information?
Spirit Pieces may share your PII with the following parties:
• Service providers that provide Spirit Pieces with information technology, software as a service, cloud storage, or other administrative services;
• Live chat service providers, which may have access to your real-time communications with Spirit Pieces;

Spirit Pieces may also transfer PII to third parties when it sells, transfers, or merges any part of its business or assets.
Spirit Pieces requires all third parties that receive a transfer of PII from Spirit Pieces to maintain the same level of respect for the protection of PII as Spirit Pieces, and Spirit Pieces only allows third parties to process your personal data for the specific purposes listed in this Privacy Notice.
How do we protect your information?
We implement a variety of security measures to maintain the safety of your personal information, including when you place an order. However, no security measures are impenetrable and there are always security risks. Spirit Pieces has put into place data security measures to protect your PII. Spirit Pieces allows access to your PII only by employees and service providers who have a need to know or access your PII on Spirit Pieces’ instructions. Spirit Pieces will notify you and any regulatory body of any breach of your PII or Spirit Pieces’ security measures if it is legally required to do so.
Do we use cookies?
Yes, as stated above, we use persistent and session cookies, as well as tracking pixels and other similar technologies described in the Tracking Technologies and Pixel Disclosure section above. Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your web browser (if you allow) that enables the site’s or service provider’s systems to recognize your browser and capture and remember certain information.
We use cookies to help us remember and process the items in your shopping cart, understand and save your preferences for future visits, and compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future.
For how long do we retain your data?
We will only retain your PII for so long as necessary to fulfill the purposes for which it is collected under this Privacy Notice or for the purposes of satisfying any legal, accounting, or reporting requirements. With respect to location data, technical data, usage and interaction data, and marketing data, we may retain this data for so long as it is relevant to the uses disclosed in this Privacy Notice. We may retain account data, public data, and communications data for so long as you maintain a user account with Spirit Pieces, and we may retain this data for longer periods where there is a need to retain this data to comply with Spirit Pieces’ legal obligations, such as the preservation of electronic evidence or compliance with a preservation order. Spirit Pieces may retain your biometric data until it is no longer used or for a period of three (3) years, whichever is shorter.
Children’s Online Privacy Protection Act Compliance
We are in compliance with the requirements of COPPA (Children’s Online Privacy Protection Act). We do not knowingly collect any personal information from children under 13 years of age. Our website, products, and services are all directed to people who are at least 13 years old or older. If we become aware that we have inadvertently received personal information from a visitor under the age of 13, we will delete such information from our records. If you are a parent or guardian and believe that your child under age 13 has provided us with personal information, please contact us at admin@spiritpieces.com so that we may take appropriate action.
Right of Access, Rectification, Correction, Erasure, Transfer, and Withdrawal
Under applicable law, you may have a right to request access to your PII for rectification, correction, erasure, transfer, or restriction, or to object to its processing or withdraw your consent. If you wish to exercise any of these rights, please contact Spirit Pieces as disclosed in this Privacy Notice.
You do not need to pay a fee to access your PII or to exercise your rights. However, Spirit Pieces may charge a reasonable fee if your request is unreasonable or excessive.
To confirm your request, Spirit Pieces may need to request specific information from you as a security measure to ensure that PII is not disclosed to an unauthorized third party. Spirit Pieces will attempt to respond to all legitimate requests within forty-five (45) days, subject to extension as permitted by applicable law.
California Privacy Rights
The following rules apply solely to visitors, users, and others who are residents of the State of California. Spirit Pieces’ collection and use of California consumers’ personal information is governed by the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, “CCPA”), and regulations promulgated by the California Privacy Protection Agency (“CPPA”).
Categories of Personal Information Collected
California residents have the right to be notified which categories of personal information are being collected and the purposes for which the personal information is being used. In particular, we have collected the following categories of personal information as defined in the CCPA within the last twelve (12) months, as further described above in this Privacy Notice:
• Identifiers (Category A), such as name, postal address, email address, IP address, and phone number;
• Customer records information (Category B), such as name, address, telephone number, and payment information;
• Commercial information (Category D), such as records of products or services purchased or considered;
• Internet or other electronic network activity information (Category F), such as browsing history, search history, and information regarding interactions with the Website, advertisements, or email communications; and
• Biometric information (Category E), specifically fingerprint data submitted by customers for product personalization purposes.
We obtain these categories of personal information directly from California residents when they complete forms through our website, use our chat feature, use our fingerprint personalization feature, or provide it to us as part of a transaction or inquiry concerning our products. We also obtain these categories of personal information indirectly from California residents while observing their actions on our Website and from third parties or service providers that they have authorized to receive and share personal information.
Your CCPA Rights
California residents have the following rights under the CCPA:
• Right to Know: You have the right to request that Spirit Pieces disclose the categories of personal information it has collected about you, the categories of sources from which that information was collected, the purposes for collecting or selling/sharing that information, the categories of third parties with whom Spirit Pieces shares that information, and the specific pieces of personal information Spirit Pieces has collected about you.
• Right to Delete: You have the right to request that Spirit Pieces delete any personal information that Spirit Pieces has collected from you, subject to certain exceptions.
• Right to Correct: You have the right to request that Spirit Pieces correct inaccurate personal information that it has collected about you.
• Right to Opt-Out of Sale or Sharing: You have the right to opt out of the “sale” of your personal information and the “sharing” of your personal information for cross-context behavioral advertising (including the use of tracking pixels and cookies for targeted advertising purposes as described in the Tracking Technologies section above). To exercise this right, please see the “Do Not Sell or Share My Personal Information” section below.
• Right to Limit Use of Sensitive Personal Information: You have the right to direct Spirit Pieces to limit its use of sensitive personal information (including biometric data) to that which is necessary to perform the services you have requested. Spirit Pieces does not use sensitive personal information for purposes other than those specified in this Privacy Notice.
• Right to Non-Discrimination: You have the right not to receive discriminatory treatment for exercising any of your CCPA rights.
Do Not Sell or Share My Personal Information
Spirit Pieces may “share” your personal information with third-party advertising and analytics providers for the purpose of cross-context behavioral advertising through its use of tracking pixels and cookies as described in the Tracking Technologies and Pixel Disclosure section above. California residents may opt out of this sharing by contacting us at admin@spiritpieces.com or by exercising the opt-out choices described in the Tracking Technologies section above. Spirit Pieces honors opt-out signals transmitted via the Global Privacy Control (“GPC”), a browser-based signal that allows you to express your opt-out preference automatically. If your browser is configured to send a GPC signal, Spirit Pieces will treat that signal as a request to opt out of the sale/sharing of your personal information.
Even if you opt out of the sale or sharing of your personal information, you may still see advertisements from Spirit Pieces or Spirit Pieces’ advertising partners that are not based on your personal information. To verify your request, we may request certain information from you to confirm that you are a Spirit Pieces user, such as your phone number, username, email address, city, state, or geographic location. You may also designate an authorized agent to make a request on your behalf; to do so, you must provide Spirit Pieces with proof that the individual or business has been appointed as your agent (such as a signed power of attorney form) and provide accurate verification information. Spirit Pieces will respond to verified requests within forty-five (45) days, with a possible extension of an additional forty-five (45) days where necessary. Spirit Pieces will not charge a fee for processing a request unless the request is manifestly unfounded or excessive.
Colorado Residents
The Colorado Privacy Act (“CPA”), effective July 1, 2023, may apply to Spirit Pieces if it controls or processes personal data of 100,000 or more Colorado consumers per calendar year, or processes personal data of 25,000 or more Colorado consumers per year and derives revenue or receives a discount on goods or services from the sale of personal data. If the CPA applies to Spirit Pieces’ processing of your personal data, you may have the following rights:
• The right to access your personal data;
• The right to correct inaccurate personal data;
• The right to delete personal data concerning you;
• The right to obtain a portable copy of your personal data;
• The right to opt out of the processing of personal data for the purposes of (i) targeted advertising, (ii) the sale of personal data, or (iii) profiling in furtherance of decisions that produce legal or similarly significant effects; and
• The right to appeal a refusal to act on a rights request.
